About Jindrich Kloub

Jindrich Kloub is a case handler in the cartel division of the European Commission's DG Competition. In his position he deals with all aspects of the investigation and prosecution of international cartels. Prior to joining DG Competition, Jindrich worked in private practice in an international law firm in Prague, Czech Republic, dealing with corporate as well as antitrust matters. Jindrich obtained his law degree at the Charles University in Prague and received an LL.M. from Columbia University in New York, where he was a Harlan Fiske Stone scholar. He teaches competition law as a visiting professor at the Catholic University in Lille and regularly writes and speaks at conferences on all areas of competition law with a particular focus on cartels and private damage actions, which are also the subject of his doctoral thesis. Jindrich is a member of the section of antitrust law of the American Bar Association.
Upcoming judgment in case C-17/10 Toshiba and Others to shed light on the question of parallel proceedings within the ECN

On 14 February, the Court of Justice will deliver a ruling on a preliminary reference by a Czech Regional Court in Brno, which is likely to provide welcome guidance on the issue of parallel proceedings within the ECN and the principle of ne bis in idem.

The case concerns the legality of the Czech NCA’s decision against the Gas Insulated Switchgear cartel, which was also sanctioned by the European Commission’s decision of 24 January 2007.
